Financial Settlements

Financial Settlements

Financial Issues

When you divorce or end a civil partnership, you and your ex-partner need to decide how to separate your finances. This includes items such as

  • Your family home
  • Any other property you own, including holiday homes, investment properties and their respective rental income
  • Pensions
  • Savings and investments
  • Income
  • Company shares and dividends
  • Family businesses

Other financial considerations may apply, and I can advise you according to your individual circumstances.

What is mediation?

Unless there is a history of domestic violence in your case, all parties must engage, or attempt to engage, in mediation before court proceedings are issued.

Mediation is normally advised for couples who need help agreeing on a financial settlement. This involves both parties setting out their respective finances in the presence of an impartial mediator. The meeting can also be done remotely, via an online consultation, but either way it is important for each partner to have independent legal support.

As a family law and divorce solicitor I can arrange mediation for you, help you with the terms of any agreement reached, and draft the paperwork required for court. Mediation can cost between £120 - £300 per session.

Will you have to go to court?

You can usually avoid going to court hearings if you and your ex reach an agreement on how to split your money and property. Bear in mind, however, that the agreement will still have to be approved by the court in order to become legally binding.

As an experienced solicitor, I will draft the required paperwork for you and provide expert legal advice, because it is vital to ensure your assets are protected in the event of any significant changes in your financial situation in the future.

How much will it cost to reach a financial settlement?

If there is work to be done to agree a financial settlement and/ or arrangements for children, the cost of this varies according to the complexity of the case, the individual’s circumstances and the amount of legal work required by the solicitor to achieve the best possible outcome. Everybody's situation is different and there is no one-size-fits-all template when it comes to financial settlements. If you want to know how much I think your case will cost, please call me so that I can discuss your case in detail.

Helping you through the court process

If you cannot reach an agreement, I will provide expert guidance throughout the entire court process. I am committed to keeping your legal costs to a minimum.
